Minor Tanning-Bed Ban Stalls on DiSanto Absence

An hour and a half of riveting testimony and vigorous committee debate resulted in stalemate for the tan ban last week. House Bill 1166, a bill to ban minors from tanning beds, got its first hearing before House Health and Human Services last Thursday. The committee heard seven proponents and five opponents, including two lobbyists for the South Dakota Tanning Salon Association (yes, there is such an association). Committee members considered amendments to lower the ban age to under 14, to allow 14- to 18-year-olds to tan with consent from a parent and a physician, and to allow those teens to tan with just a note from a parent. The latter amendment came close to passing, but foundered, like the bill itself, on a 6–6 vote. Chairman Scott Munsterman, unable to secure one more vote, had to defer his bill to February 19.

Rep. Lynne DiSanto, R-35/Rapid City
Rep. Lynne DiSanto, the House needs your mild and beneficent glow!

The stalemate happened because HHS committee member Rep. Lynne DiSanto (R-35/Rapid City) skipped work Thursday. That's too bad, because Rep. DiSanto, Rapid City's maven of modeling, knows a thing or two about young women and fake tans. Rep. DiSanto surely could have shone a fierce professional light on the issue and helped the committee come to a decision.

So when Rep. DiSanto comes to committee Thursday, how will she tilt the vote? Will she pick up Teen Vogue and deem fake-baking the new smoking? Or will Rep. DiSanto stand for carcinogenic liberty with her bronzed commodities and Facebook Likes?

p.s.: Eleven states ban minor use of tanning beds. 41 states have some sort of minor-tanning regulations. South Dakota has no such regulations.

pp.s.: So if the Legislature passes both HB 1166 and HB 1212, which defines embryos as minors in an attempt to ban abortion, will that mean pregnant women won't be able to use tanning beds?

I believe Lynne was out with the flu. We hope people with the flu don't show up in the Capitol. If they came to our caucus only, you may have found a way to make your party the majority for a few days :)

  2. 96Tears 2015.02.16

Thank God a serious bill is being worked on in Pierre! Representative DiSanto, will I still be able to carry my Glock G32 in the tanning booth so that I may feel safe from Obama and fence-jumping immigrants? If I can't, will you please pass such a law? I must be protected at all times by exercising my 2nd Amendment rights.

  4. Elizabeth May 2015.02.16

I never look at this blog because it has NO creditability. I'm making an exception today! Lynne was out with the flu. She doesn't have the opportunity to sit behind a computer and spew rhetoric! Of course that's all liberals like you can do because you don't have the courage to put your money where your mouth is! And to "96Tears" (who doesn't have the courage to use his/her name) I'll makesure to do everything I can to ensure you get to carry that Glock in the tanning bed! Just be careful and don't hold it to close to your face, we hate for you to have a tanning mark that offended your liberal counterparts!

  5. caheidelberger Post author | 2015.02.16

Hang on, Rep. May: just what money am I supposed to put where my mouth is? What courage do I lack? And how will my carrying a gun into a tanning bed help me demonstrate my courage?

And tell Rep. DiSanto to drink some orange juice!

Lee, I don't think we Dems need to resport to biological warfare just yet. But if the Republican conception of liberty continues to revolve around smoking, tanning, and driving while texting, maybe the Dem majority will arise from natural selection.

It appears the industry will take a 10% hit maximum if an 18 and under ban passes. Either the industry figures out a way to adapt to the changing market or they go the way of blockbuster videos. This issue is fourfold: business and free market, health and responsible parenting. In trying to get good info on this industry in SD it appears there are half the number of tanning salons as there were at the peak. Owners blame taxes. I don't buy it. There is a significant downward trend in this industry without govt regulation and tax changes.

I'm glad Lynne stayed home-- doc says flu or pneumonia could do me in. We can vote on tanning beds when she feels better.

Libby, Libby, Libby. Tut tut. Such anger. Ow.

Save your self-righteous venom for your constituents. They're gonna want to know how you spend so much time in the State Capitol and still get nothing of any value done. Little wonder you folks think you must carry guns in the State Capitol.

Look behind you,Ms May- a squirrel! Only a wingnut would actually think you need a gun in a tanning bed. What do you set your gun at? UV phasor.

Tanning beds are not safe. However,in keeping with wingnut philosophy,it is better to allow free market approach on one end and then deny tens of thousands of South Dakotans health care at the other end. Let 'em burn and make them suffer.

  14. leslie 2015.02.16

cory-the blog is certainly pissing off the mays, tieszens, brocks, ect, of the legislature.

they don't like the one-on-one opportunity for exposure the blog offers an elected official to attempt civil communication. hickey and nelson appear brighter.

it exposes the clear flaws of thinking, disrespect, illiteracy, fear, partisanship, sometimes racism, they have for their fellow citizens and even illegals (humans) that differ even slightly from their narrow world view.

we regulars on madville can model a better society, and often do. we have our faults without question, and many detractors in our midst, republicans, who believe they have the only insight because of their majority.

the democrats are the whipping "boys" because of their minority. we don't have the answers to victory, but we are not going anywhere. we will continue to mirror back what we see that is cruel, unjust, dishonest, childish and dangerous in the republican ownership of SD.

    things will change.

  15. Taunia 2015.02.16

"...to ensure you get to carry that Glock in the tanning bed! Just be careful and don't hold it to close to your face..."

Wow. Did a sitting state rep just underhandedly wish harm upon a voter? If a constituent had said that to an office holder, the police and maybe the FBI would be investigating.

  16. Jim 2015.02.16

    Dear Ms. May,

Nice of you stop by and contribute to the discussion. I suspect Cory's ideology may differ from yours, but that doesn't translate into a lack of credibility on his part. I may like coke and you like 7-up, but that doesn't mean we are not credible. If you want to criticize a comment section, you should start with the anonymous echo chamber Pat Powers allows at his site. At least Cory requires people to ID themselves to him. The resulting level of decorum and thoughtful discussion at this site is far superior to that at the DWC where RINOS supposedly lurk behind every bomb that gets tossed over there. If you don't believe me ask Troy Jones or Lee Schoenbeck and I'm quite certain they will agree.

p.s. Dont forget to use hand soap, and you might want to wear a vest until legislators can carry guns.

  17. Craig 2015.02.16

Elizabeth May: "I never look at this blog because it has NO creditability."

Uh... speaking of a lack of credibility - I'm pretty certain your statement is a blatant lie since you just commented on a blog you never look at.

Second, your statement about someone holding a gun "to [sic] close" to their face is evidence enough you lack the maturity to be in public office. Thankfully you appear to have climbed as far as you are capable of on the political ladder, but I'm saddended such ignorance is supposedly shaping legislation in Pierre. South Dakota deserves better.

  18. Craig 2015.02.16

It is rubbing off on me. Obviously "saddened" is what I mean to type. Perhaps I'm the one with no "creditability"... whatever that is.

  19. Elizabeth May 2015.02.16

What I find amazing about this blog and all the rest, none of you have guts (other than Corey) to put your full names and credentials out there! I like ya Corey, but your followers need to come out of the shadows! Oh by the way Craig (whoever you are) I came to this blog, because I don't have much tolerance for attacking someone who's got the courage to actually try to make a difference. You ought to try it sometime.....Thanks Corey, good entertainment for the day! You rock....

  20. larry kurtz 2015.02.16

So, we can add Ms. May to the list of legislators bringing firearms into the Statehouse.

  21. Tim 2015.02.16

  22. mike from iowa 2015.02.16

Gawd almighty, woman, you sure changed your tune in short order. From Cory has no creditability to Cory, you rock. BTW,Cory is happily married so stop making calves eyes in his direction. Very unbecoming of a politician.

Elizabeth May may very well be the next GOP VP pick.

Do you shoot wolves out of helicopters there ol Mama Grizzly?

Is Cory part of the lamestream media?

Can you see Russia from your house?

  25. Craig 2015.02.16

Elizabeth May: "Oh by the way Craig (whoever you are) I came to this blog, because I don't have much tolerance for attacking someone who's got the courage to actually try to make a difference."

Seems you have this politician thing down. First you claim you never come to this blog, and now you are trying to justify coming. So I suppose you were against this blog before you were for it... or something like that.

Second, you claim you don't have tolerance who attacking those who have the courage to try and make a difference, yet you immediately come out against Cory and his blog which shows you honestly don't care about those trying to make a difference. In case you are willfully ignorant, I'll remind you that it was Cory that researched and reported on fraudulant signatures being used in the Bosworth campaign - so unless you don't think that integrity or honesty matter in politics, then you'll have to admit Cory is in fact making a difference. That is but one small example of many, but trust me... Cory does make a significant difference even though much of it might not align with your political viewpoints.

You can accuse Cory and "all liberals" of spewing rhetoric while doing nothing other than spewing rhetoric, but at least I haven't seen Cory make any tasteless jokes about people shooting themselves.

Then again why waste my time responding to you when you "never" read this blog anyway right Ms. May? Yea that's what I thought.

P.S. - Craig is actually my real name - pardon me for not providing my last name to the types of people who wish for others to be on the wrong end of an accidental discharge of a firearm. Keep it classy Liz.

  26. caheidelberger Post author | 2015.02.16

I share Rep. May's preference for conversation by name. I share her respect for those who try to make a difference. I just wish Rep. May would try to make a difference with some good policy instead of either what the GOP leadership tells her to vote for or, often worse, the radical right-wing crazy ideas that bubble up out of the Legislature.

That said, Rep. May—how will you vote on the minor tan ban?

  27. Owen 2015.02.16

Rep. May. My name is Owen Reitzel and I live in District 19. Do you need more as far as credentials?
What the Republican party is doing in Pierre is almost criminal. Crazy gun laws being proposed, a Governor who cares more about roads and bridges for big business then about education.
A Republican led legislature that thinks its a good idea to appoint a "blue-ribbon" for education when this has been studied to death.
A Republican led legislature that wants to raise its own pay but doesn't care about about raising teachers salaries.
This tanning bed bill I'm sure means something to a few people but in the bigger scheme of things its small potatoes. Attacking? Maybe just trying to show you a little courage that you've ask for.
I've told you who I'm am. Now lets have a discussion if you have the courage to do it.

  28. Nick Nemec 2015.02.16

Rep. May my name is Nick Nemec. Rest assured that whenever I comment on this or any other blog I post as Nick Nemec.

  29. Bob Newland 2015.02.16

Rep. May: I'm Bob Newland, really. I live in District 30, perhaps the most under-represented district in South Dakota, although it appears your district may be vying for the title. Your outbursts here are evidence that you have no filter.

  30. Jason 2015.02.16

    Rep. May:

My name is Jason Sebern. I am an educator at Brookings High School. I would like to be able to give myself a 66% pay raise. But I know that's not fair to the taxpayers. Instead I will just get another part-time job to make ends meet. Your humble servant.

  32. grudznick 2015.02.16

Ms. May. That is really Mr. Newland. He is a swell fellow in Mr. Russell's town. They have much in common.

  33. Lorri May 2015.02.16

    Representative May,

I'm *so* glad we're not related.

    Sincerely,
    Lorri May

  34. grudznick 2015.02.16

Mr. H, you seem to have way more of the legislatures blogging here than Mr. PP has at his web. It would be nice if that continued but I wonder if all the insaner libbie attacks will drive them away. Imagine the creditability you'd gain above 800 if you had lots of the senators debating points by blogging them here.

  35. Roger Cornelius 2015.02.16

Elizabeth May is what happens when Native Democrats on the Pine Ridge Indian Reservation don't vote. She is the poorest example of the kind of representation the reservation needs.
Demanding people's names on any blog is beating a dead horse and usually isn't relevant to their comments to began with and has little to do with their character or credibility.
Using your name on a blog doesn't necessarily give anyone more credibility, as Elizabeth has demonstrated by using her name, she says some pretty stupid and childish things.

  36. grudznick 2015.02.16

I am surprised that Ms. May represents Wanblee. I see she has served for a while. They need to vote her away.

  37. Roger Cornelius 2015.02.16

Elizabeth tosses around the word credibility like she knows what it means.
Let's see if knows the meaning by answering a simple credibility question.
Elizabeth, South Dakota ranks high in political and crony capitalism corruption, when the legislature wanted to reinstate the ethics commission, how did you vote?

  38. 96Tears 2015.02.16

Does Betty May make her interns read the political blogs and send her memos when they see her name? Wouldn't that be miserable? It would be like schlepping for Anna Wintour on a Wal-Mart budget.

  39. Deb Geelsdottir 2015.02.16

Rep. May, my name really is Deb Geelsdottir. Who would make up a name that long and unusual? I have to spell it out repeatedly. I am also very liberal, more so than most SD Democrats. I'm not rude, I don't attack other commenters, and I have some good ideas that would be helpful to SD, a state very dear to me and my home for the first 50 years of my life. I continue to care very much about it and my loved ones who still inhabit the state.

So am I acceptable to you even if I disagree with you on most things?

  40. caheidelberger Post author | 2015.02.16

Rep. Hickey makes an interesting point about the industry in decline. I share his doubt about blaming taxes. I can easily Google up articles about tanning going out of style over the past decade. I am of the impression that fewer people are hitting the tanning beds as hard as they used to. (Say, when did these tanning beds really take off?)

  41. jerry 2015.02.16

Elizabeth may or may not. I think I agree with Roger, she is what happens when you do decide to sit out the vote.

  42. beverly Meyer 2015.02.16

Tanning beds are very last century. They have fallen out of favor just as sitting in the sun for hours has. Now for the best 15 years, spray tans are preferred. Tanning parlors have gone the way of 8 track cassettes and giant boom boxes. This simple fact may account for the dwindling of tanning beds, plain and simple. Some parts of the country move on slower than others..

  43. Elizabeth May 2015.02.16

You know me Corey, I'm a NO vote on tanning beds and yes on hemp! lol It's official I'm hooked you have a great blog and even few bloggers had the coursage to use their full name. Now all you have to do to make this blog complete is to set up a profile page. Love it....

  44. 96Tears 2015.02.16

So far, all I know about Rep. Lynne DiSanto is she runs a modeling rental service, got featured in the Rapid City Journal, caught the flu and seems to be the most essential legislator on a cosmetology treatment that is out of date and harmful to everyone's health. A star in the making.

Say, is anybody doing anything about getting South Dakota's $120 million back from Joop Bollen? Just wondering.

  45. Roger Cornelius 2015.02.16

    96Tears,
I asked Elizabeth May how she voted on reinstating the ethics committee, which is important to giving this state credibility and fighting corruption.
    She choose not to answer.

  46. Elizabeth May 2015.02.16

Some more thoughts Corey, What about a like button like FB. There were several blogs on me I like. Also, add a drop box for additional comments. I think those two things would really get this rocking and rolling! What do do think?

  47. mike from iowa 2015.02.17

Want my profile-it is scattered all through the recent archives . Where I'm from, where I went to school. What I did for a living. Just need to look in the last couple of years-its all there.

As for politics,I prefer sidewinders to wingnuts.

  48. caheidelberger Post author | 2015.02.17

Rep. May: No on tanning beds... meaning yes on the tan ban?

And yes in hemp—where's the bill? Or will you be promoting an initiated measure? Either way, I'm with you there. Hemp can be the next great cash crop. Let's make some hemp rope and plywood!

[I had a Facebook button, but the widget slowed load time and messed up format. If you know of a cleaner widget, let me know. And a drop box for additional comments—can you show me an example on another blog?]

  49. 96Tears 2015.02.17

Roger, it seems that Republican legislators believe it's nobody's concern than their own how they vote and behave when they're in those hallowed halls of our State Capitol (and cuttin' it loose at night at the Ramkota bar and the Hop Scotch). As to ending corruption, in Pierre that would be viewed as a job killin' affront to their Holy Job Creators.

It's funny, because their campaign literature portrays them as patriots who are for education, jobs, lower taxes and less guv'mint. It must mean they're for only as much guv'mint as it fills their pals' pockets and keeps those pesky Dam'crats on the rez from voting.

  50. Roger Cornelius 2015.02.17

    96Tears
It wasn't lost on me how quickly May saying Cory and Madville posters had no credibility to praising him and ultimately making suggesting, all while artful dodging direct questions about her own credibility on her ethics committee vote. We all that when you change gears too quickly you can strip your transmission.
By not voting for the reinstatement of the ethics committee, I put May in the pro-corruption category.

  51. Deb Geelsdottir 2015.02.17

I want to offer a little support to those who use pseudonyms.

Sometimes there are very good reasons for protecting one's identity that have nothing to do with the writer's moral courage. I do not have less respect for a comment because the writer uses a pseudonym. I judge by the quality of their comment.

I take Grudz with a shaker of salt. That's not because he uses a pseudonym. It's because I believe he enjoys being a provocateur and doesn't always believe what he writes.

On the other hand, I have high regard for BCB because his comments are smart and reasonable.

On my third hand is SS. He uses his full name and he is just plain nuts! I don't read his comments at all. Life is too short to bother with him.

  55. beverly meyer 2015.02.20

I am wondering, Rep DiSanto has three minor children. She feels that who tans should be dictated by their parents' wishes. It should not be mandated by the "nanny" state. How does she feel, given that there are minors involved - Should parents be the ones to stop their children from buying a bottle of vodka if their are no laws prohibiting the sale of alcohol? What about cigarettes. Where do you draw the line. It has been a loooong time since I was a minor, but I remember sneaking cigs and booze from my parents even though they were not allowing it. Good luck in getting total compliance from teenagers on anything they really want. In a perfect world………..
