Arrest Warrant Issued for Annette Bosworth

I told you so.

Former South Dakota Senate Candidate Dr. Annette Bosworth was informed at 9:28am this morning by Sgt. Jason Gearman of the Minnehaha Sheriff’s office that a warrant had been issued for her arrest by Attorney General Marty Jackley.

Bosworth was told by her attorney that the charge relate to election activity, specifically petition signatures [Lee Stranahan, "Arrest Warrant Issued for Former S.D. Senate Candidate Annette Bosworth," LeeStranahan.com, 2014.06.04].

Six counts of offering false or forged instrument for filing under SDCL 22-11-28.1:

22-11-28.1. Offering false or forged instrument for filing, registering, or recording--Felony. Any person who offers any false or forged instrument, knowing that the instrument is false or forged, for filing, registering, or recording in a public office, which instrument, if genuine, could be filed, registered, or recorded under any law of this state or of the United States, is guilty of a Class 6 felony.

Six counts of perjury under SDCL 22-29-1, 22-29-8, and 22-29-10:

22-29-1. Perjury--Violation. Any person who, having taken an oath to testify, declare, depose, or certify truly, before any competent tribunal, officer, or person, in any state or federal proceeding or action in which such an oath may by law be administered, states, intentionally and contrary to the oath, any material matter which the person knows to be false, is guilty of perjury.

22-29-8. Oath defined--Irregular oath. The term, oath, as used in this chapter, includes any affirmation, and every other mode of attesting the truth of that which is stated, which is authorized by law. It is no defense that the oath was administered or taken in an irregular manner.

22-29-10. Deposition or certificate as complete upon delivery--Intent. The making of any deposition or certificate is deemed to be complete, within the provisions of this chapter, from the time when it is delivered by the accused to any other person with intent that it be uttered or published as true.

Six counts... Bosworth swore a false circulator's oath on five petition sheets. Her husband Chad Haber did so on one more. 5 + 1 = 6.

Update 14:20 CDT: John Hult of that Sioux Falls paper provides me a copy of the affidavit sworn by DCI agent Bryan Gortmaker, the formal charges, and the arrest warrant. Significantly, Gortmaker cites Bosworth's own media appearances (KELO-AM with Greg Belfrage on April 17, then her graffiti-cursing press conference on May 27) as evidence supporting the charges. Remember, anything you say can and will be used against you in a court of law.

Update 14:40 CDT: From Attorney General Marty Jackley's office:

Attorney General Marty Jackley announces that two separate Complaints have been filed charging Annette Bosworth, 42, Sioux Falls and Clayton Walker, 33, Rapid City with election law violations. The Complaints have been filed in Hughes County where the nominating petitions were filed and are accompanied with a Probable Cause Affidavit setting forth the investigation conducted by the South Dakota Division of Criminal Investigation. Counts 1A- 1-F of both Complaints charge offering false or forged instrument for filing and constitute Class 6 felonies each punishable maximum sentence of two years imprisonment and/or $4,000 fine. Counts 2A-2F of both Complaints charge perjury and constitute Class 6 felonies each punishable maximum sentence of two years imprisonment and/or $4,000 fine.

The election complaints received by the Secretary of State involve conduct that is serious, deliberate, and must be addressed in order to preserve the integrity of our elections. Because this is a federal elected office, I have and will continue to discuss the investigation with federal authorities,” said Jackley.

The case is being investigated by the Division of Criminal Investigation and prosecuted by the Attorney General’s Office. A tentative initial appearance date is scheduled for June 23 at 9:00 a.m. at the Hughes County Courthouse. Bosworth and Walker are presumed innocent until such time as the state proves the allegations beyond a reasonable doubt [emphasis mine; Attorney General Marty Jackley, press release, 2014.06.04].

    Cory, I appreciate the time and effort you've put into exposing the corruption of these individuals who seem to think the rules don't apply to them. I also want to thank those who were brave enough to expose themselves by exposing the truth about Dr. Bosworth, Chad Haber, and their business of screwing people over. I witnessed first-hand the damage that these individuals can do to an employee, not only because of non-payment of wages, but also verbal abuse and aggression. Unfortunately, because of what seems to be a personality disorder (I know, I know...I write 'seems to be' in order to avoid being on the receiving end of a frivolous lawsuit), neither Chad nor the good doctor will recognize that they have done anything wrong.

    I watched her video on the Argus website responding to the charges. These charges are the culmination of years of persecution of her by Marty Jackley. The petition signatures are all valid she says (even though she didn't actually witness them as the circulator). Marty Jackley makes her cry. He made her cry. The sheriff didn't even give her a chance to eat breakfast before calling her about the warrant this morning at 8:45. Why is everybody so mean to this lady who just wants to go back to treating her patients and running the PAC she announced yesterday? The writing is on the wall.     Steve, I agree that it is unfair to paint every Republican in the state with the Bosworth brush. She is a RINO. She has no ideology.

    However, this is why (as PNR points out) the Republican Party should have acted sooner to weed out her crimes. Bosworth tarnishes the brand and makes it easy for the national media to take potshots at Republicans in general. That's still unfair, but the GOP could have insulated itself from those unfair attacks by acting sooner.

    In the video she said at the end she's going to take her lawyer's advice and not talk about it. I wonder who her lawyer is now, because it can't be Joel Arends. You see, Joel Arends is a fact witness in this case. He's the one who notarized the allegedly perjured circulated signatures. He can't be her lawyer when he's a fact witness. Did she actually sign as circulator? Only Joel Arends and Annette Bosworth know that, and she can't be compelled to testify.

    That said, it must really burn her that she's presumably paying her lawyer and he's attending fundraisers for the guy who has been persecuting her and is now prosecuting her. Her long-time attorney seems to have divided loyalties. Maybe he's even giving Bosworth's money to Marty Jackley. She should ask her new lawyer about the advice of counsel defense. Arends knew she was in the Philippines when the pages were circulated since he was there too. If he advised her to go ahead and sign the petitions as circulator, it may be a legal excuse for her actions. And she could really throw Arends under the bus.

    Here is why I believe we haven't heard anything from Arends. He will have to recuse himself as her attorney, because there is a HUGE CONFLICT OF INTEREST. If he isn't charged (and maybe he has that Republican heat shield, as so may conspiracy theorists claim), he would almost assuredly be named in a civil suit by Bozworth/Haber. They will have to sue someone to get the money to pay the fine on this one. Arends is the logical choice, as he acted as their attorney in all of this and, if I'm not mistaken, he made some pretty damning statements that they had broken no laws concerning the petitions. He is wide open for a major civil suit. I suppose his liability is reduced if they never paid him anything for his services, which may be the case! But then, who would represent them? Haber once told me that they had used several attorney's, but their choices had grown limited by the fact they owed them all so much money. I suppose Annette could get a public defender. Now, here is the second thing. What is Chad doing with all of this? He has to ask his Facebook followers what to do????? I'll bet he is perfectly content to let his wife take the fall for this. He has probably been telling her that nothing will come of this, and she shouldn't worry, and, of course, she believes it. Personally, I think she will have the full force of the law put into this one. If not, it green-lights anyone to mess around with the election/petition process. If I heard it right on the news, the penalty here is up to a $25,000 fine and two years in prison. I am pretty sure about the prison, but not as certain about the fine. If she only listened to me in June of 2013 when I told her bad things would come from this. At the very least, she is going to lose her medical license, won't she? I am not an expert on the subject, but I believe, at least in South Dakota, one can't have a medical license with a felony on her record. Someone, please correct me if I am wrong.

    Dave-Class six is max 2 years and 4k. Class 5 is 5 years and 10k. I believe that 6 of the charges...the forgery ones are class 5. I may be mistaken. I know the perjury are class 6.
    So each can be tried individually for a total max of 42 years and 74k. (if 6 are indeed class 5 felonies)
    She won't get that much. No way...first time felon, she won't.
    I doubt the state will plea to a misdemeanor but they may drop some of the charges or run the sentences concurrently rather than consecutively. If run concurrently the largest sentence takes precedence.
    My guess is she will be found guilty of a felony but get a suspended imposition of sentence. That means she will have a parole agent, she will have to adhere to parole stipulations (including having a job, not moving, not leaving state, not voting, not having a gun, curfew, etc). With the suspended imposition if she completes the sentence successfully the felony will be expunged.
    If she is given just a suspended sentence (not suspended imposition) again she would not be run through the system but the felony would not drop off without a pardon after 7 years off parole.
    That is my guess. I do disagree with you about the fine. I think she will get hit hard in the pocket book.
    A felony is not an immediate loss of medical license in South Dakota, she still has to stand before the board and they must show probably cause to revoke.

Afterall,she is entirely innocent and is just being picked on because of her religion. This woman doesn't march to the beat of a different drummer.     Conrad, the violation you're speaking of would have to be prosecuted by the U.S. Attorney, since that's Federal Election Commission rules. Of course, our state Attorney General has said he is cooperating with the U.S. Attorney. Conrad, perhaps you should send a note to AG Jackley and US Attorney Brendan Johnson.

    Cory I don't know in the grand scheme of things if her watch is that big of a deal. E-bay shows used Rolex that I can see as close to the photo at $2000,$5000 and up. It could be another well respected lesser quality and certainly less expensive brand, A cheap brand or a fake.

    Troy, I hear you suggesting that I'm suggesting the party as an entity interfere in the conduct of a primary to shut out a candidate, which of course is naughty. Perhaps I misspeak. Perhaps I should only refer to members of the Republican Party:

    --Instead of fronting for Bosworth, soft-pedaling criticism, publishing and promoting Chad's obvious lies about me (whatever happened to the SF Police who were supposed to be investigating my breaking and entering of Chad's locked desk?), and banning my comments, Pat Powers should have gotten on his investigative horse and ridden Bosworth hard.
    --Secretary of State Jason Gant should have taken his duties more seriously and responded immediately to all planks of my challenge instead of dealing with just one, punting a second to Jackley, and ignoring the third and fourth.
    --More Republicans should have taken the Lee Schoenbeck route and publicly dismissed her as a fraud.
    --More Republicans should have made her feel unwelcome at the Lincoln Day Dinners.
    --More Republicans should have told that 5.5% of their friends not to waste their vote on Annette (though I suppose there is just no getting through to some people).

    Am I advocating anything illegal or unethical, Troy?

    The Powers/powers that be in the South Dakota Republican Party were more than happy to have Annette on board to help split the anti-Rounds vote. The more the merrier was their motto on that accord. They also went out of their way to attack and denigrate Stace Nelson, an actual elected Republican who was widely seen as the candidate who was the biggest threat to the Rounds coronation.

    Wow, just watched the video of the "press conference" yesterday. That last minute or so after she finished her announcement was one of the most bizzare things I have ever seen. All of Annette in all her glory was on display at the end of the video, the Vogue pose while tossing her hair up to put on her lab coat, the condescending comments and sighs off camera as questions were being asked, and the declaration at the end that she was too busy and had "patients waiting", all with the pretty "look at me, I'm a Doctor" pose on the couch. Way over the top!

    Pat Powers is now moderating comments about Bosworth and seemingly any comments critical of his actions or inaction regarding the travesty that has been the Bosworth "campaign."

    I say this as a regular commenter and someone who has generally supported SDWC.

    Losers: All other media including this blog and the voters of SD.

    The Winners had enough courage to call her out and expose her for what she is. The rest were uncurious, uncourageous and thus did a disservice to every single South Dakotan during this campaign.

    Powers led the pack of the uncurious and uncourageous. But, in fairness, his mission was not to inform voters or expose corruption, but rather to help insure Mike Rounds won the primary. The best way to do that was denigrate Stace Nelson, who was widely perceived to be the biggest threat, and pump up all the other also rans to divide the anti-Rounds vote.

    Unbelievable Bosworth was a useful tool and her performance went beyond what they expected in serving as a distraction during the campaign helping to get Rounds nominated. Just look throughout the election how DWC handled concerns for Bosworth. He played dumb while continuing to promote the sideshow. Who were the real players that recruited her?

    PP did exactly what he was paid to do.

    Cory,

    I was just confused on what you meant by the GOP should have done things earlier, more aggressively.

    As you know, I was in the camp of leaning to more/harder/earlier but also concerned about making her a martyr/cause celebrity and the perception the legal system was being used for political purpose. I vacillated throughout the Bosworth saga.

    All in all, with the benefit of hindsight, I wish a few (not a lot) had been more aggressive ala Hickey and Schoenbeck. They were perfect as they weren't formal leadership but people of standing making a statement. If anything was missing was admonishment from an old sage in the party. Jim Abdnor would have been perfect.

    I'm glad the official party played her down as I think that would have made her a martyr which would give the sage more life. Regarding Lincoln Day Dinners, I'm real cautious about exerting formal censorship lest it again create a martyr scenario. That said, if there ever was a case I could be convinced, it was this one except I think her pathology was such she'd use it to her advantage. The political life of Bosworth is over and thus of little interest to me on the blogs. We just have the Shakespearean and criminal story left to watch unfold.

    And, most importantly, out of respect to the need for the legal system to be separate from politics (perceived and actual), I'm most glad Jackley used the time to build what appears to be a solid case backed by written evidence (a lot of which you highlighted in your work) and testimony of people (which takes time and pounding of the pavement). A quick, rushed indictment may have at worst jeopardized the case and would have enhanced her cry she is a victim.

    So, she holds another sideshow press conference yesterday to tearfully lament her arrest and how she is being persecuted. (She kept a patient waiting for that?) And now she is holding another today to discuss her perjury charges? Annette, your attorney told you to shut up about it, and you would do well to take his/her advice. I know you love the camera and think the camera loves you back, but we in SD are not your facebook sheep and see through the ruse of a campaign. Don't treat us like the gullible out of states rubes that lap up your imaginary milk and honey. Take the time set aside for your presser and go meet with your attorney.

    Chad and Annette have a camera man hired to video post charges. It looks like intended audience is not even intended for those in South Dakota who know about them but her out of state, international Facebook worshipers that have absolutely no idea what is happening. Those out of state and international followers are their meal ticket playing the woman, Christian, Republican corruption & liberal silencing campaign while they encourage donating to their PAC.
