Congresswoman Noem, pay attention: your former colleagues in the South Dakota State Legislature are threatening your pocketbook. HB 1054 would jack up the penalty for failure to appear:
FOR AN ACT ENTITLED, An Act to increase the amount that the court may assess against the defendant for failure to appear in regard to certain motor vehicle violations.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 32-33-2.2 be amended to read as follows:
32-33-2.2. If the defendant has given his or her promise to appear in court in accordance with § 32-33-2 and does not appear, the court may order or issue a bench warrant for his the defendant's arrest and may assess costs of such issuance against the defendant in the sum of ten up to twenty-five dollarsa day for each day that the defendant fails to appear.
Notice the insertion of "or her." I can't help wondering who might have popped to mind during the writing of this bill. Given the penchant of Noem's current Republican colleagues for creative bill naming, let's call HB 1054 the "Noem-More Excuses" Act.
