Judge Lets Taliaferro Quit; Bosworth Fails to Pay

Leo Kallis helps us understand why Circuit Court Judge John L. Brown approved attorney Brandon Taliaferro's request to withdraw from Annette Bosworth's defense. The reason is simple and unsurprising: Bosworth failed to pay him.

In court yesterday, the failed Senate candidate complained that Taliaferro's motion to withdraw was too vague. Taliaferro responded that he had avoided mentioning specific reasons to protect Bosworth from undesirable media scrutiny:

My motion to withdraw was intentionally vague. I did that as a benefit to you so as to limit the amount of information in the record that the press or public could get ahold of. If you consent to my withdrawal, the court likely won't require any additional information on this issue. I believe that to be a benefit to you. However, if you oppose the motion, the court will likely require additional information from me, which will then be in the record. The same goes for the motion you are considering filing. Once you file something with the clerk of courts, it's in the record and available to the press and/or public. This August 3 letter shows that even as he is trying to leave the Bosworth circus, he is still trying to serve his client's best interest. The bottom of his letter suggests Taliaferro is even trying to help her line up a new attorney (Taliaferro mentions "trying to secure Mr. Schreiber," perhaps Pierre attorney Brad Schreiber).

But again, in Bosworth's narcissistic world, no press is bad press. She throws another tantrum, and Taliaferro's reasons for withdrawing become public:

As for the obligations you failed to fulfill, they are set forth in various emails and letters I sent to you. Essentially, the obligations were:

  1. Chad [Haber, Bosworth's husband] withdraws from the AG race before our last hearing which did not occur;
  2. Lee [Stranahan, Bosworth's paid spokesman] stops mentioning me, you or Mette which did not occur;
  3. We issue a press release distancing you and your defense from Lee. That occurred, but was completely undermined by the video you and Lee put out hours after the press release; and
  4. 25,000 retainer by July 25 which did not occur [emphasis mine; Taliaferro, 2014.08.03].

Bosworth promised Taliaferro $25,000. Bosworth did not pay Taliaferro that $25,000. She continues not to pay her debts to those who have worked for her.

Bosworth doesn't pay: the story is almost so predictable as to no longer be news.

Bosworth's exploitation and abuse of her former attorneys proves her toxicity. It's almost as if she's trying to make herself unrepresentable, to drive off every respectable attorney in the state, to force us to pay for a public defender. I could tolerate footing the bill for Bosworth's constitutionally guaranteed defense if she were really destitute and lacked the means to raise money. But her mistreatment of Taliaferro, like her parasitic relations with past employees, indicate Bosworth is just looking for another freebie.

    Annette has been getting horrible advice. Anyone who's been around the horn of South Dakota politics will tell you it's very unlikely she will suffer anything worse than a fine, which probably would be suspended on the condition she's a law-abiding citizen for one year. By dragging this out and letting goofballs like her husband and Lee Stranahan speak for her, she's begging the judge to throw the book at her.

    It's still not too late, Annette, to avoid making yourself into both a convict and a fool. Settle for a plea bargain agreement and move on to salvage what's left of your reputation. Then stick to the medical practice, dump that useless husband of yours, pay your bills, love your children and enjoy your true friends. The piss ant power brokers in Pierre and their self-important pals around the state are NOT your friends.

    Friends whom I trust say she is a very good physician. I believe that. But nobody should ever let her control the business/financial arrangements.

    Rocky, 96 reiterates the remarkably generous advice frequently voiced by commenters on this blog. Even as we have looked at Annette and Chad's erratic behavior, their various scams, their unkind treatment of people who've worked for them and people who challenge them, many of us have suggested simple actions Annette could take to preserve her practice and her family life, actions that would be in the best interest of herself, her children, and her patients. Annette still has friends and neighbors who believe that, freed of all this unnecessary drama, she could be a good doctor (dare I say be a good doctor again, like she was before she started making news and going off on Chad's wild-goose chases?).

    There are plenty of people who have good reason to want to see Annette punished. But there are people (somedays, in certain moods, me included) who don't want to see Annette put in jail or stripped of her medical license. There are people of good will on this blog who believe that Annette is not beyond redemption. Her narcissism and, more importantly, her husband, make it hard to sustain that good will and generosity, but it's there, out of proportion to what she deserves, but it's there.

    Chad, however, deserves no such generosity. He may be the cause of all these problems, and he has done nothing to indicate he can do anyone any good, including his own family. Annette, tell Chad to leave, get him out of your life, and you may find your medical practice improving and your family life calming down immediately.

    I wait with bated breath for Bosworth's defenders to jump in here and say we only have one side of the story and that Talioferro is a liar and never asked for payment or any other allegations he has made. The courts should muzzle her and put her in a straitjacket so her lawyer,whoever that may be,has a chance to defend her.(legal,lawful or not)

    Honestly CAH, we all know that Chad Haber will never leave his wife and as long as she is brainwashed, she will stay with him as well. I get tired of talking about how sad it is that she has chosen this path in life when she could be a fantastic physician; I am starting to believe that maybe Ms. Boz-Haber is nearly as, if not as, much of a crook as her husband. Talifierro is smart to get out and get out soon. It's funny that on Twitter I made a comment that the vid they made was a direct insult to him and Stranahan stated I was "crazy" and "needed mental help" because I was making such a big deal out of nothing; well, seems it wasn't nothing afterall, was it? They all live in an alternate reality and expecting them to join us on the right side is like asking an elephant to climb a tree, they have no ability to do so. All of their plans will soon backfire because those of us who truly are sane can see through them and every article you write makes it easier for those on the fence to see the reality and not get involved. If they don't have an army of people to do their dirty work for them for free, then, the work won't be done; then, she's just going to have to give up the ghost.

    WestRiver, you were right: that video was a direct insult to Bosworth's attorney and a direct violation of her obligations to him.

    As for Annette's free will and crookedness... well, that debate remains open. Whatever the actual contents of her soul, I think it speaks well of the open-mindedness of commenters like 96 that they are even willing to entertain the possibility that she can redeem herself. That's more decency than Annette and Chad have exhibited toward the people with whom they disagree.

    So she won't do what her attorney requests, she won't pay him, but wants him to be stuck representing her? Anyone dealing with those two better factor in some hazard pay.

    i don't disagree with 96 tears, westriver, or corys assesment but in my opinion it doesn't go far enough. boz and haber both posses the ability and intelligence to have good incomes doing honest work but they choose not to and instead they scam and cheat ppl. why? because they get a thrill out of it...and its a big joke to them. much in the same way college roommates might haze each other. in there eyes they not hurting anyone so its not a big deal.

    taliaferro by filing before the date the retainer was due put pressure on boz to pay him. if she would of paid him he would of simply dropped the withdrawal order. instead she revealed her true intentions by trying to get ajudge to make taliaferro defend him.

    id also add 2000/felony is a pretty cheap rate. it seemed taliaferro did everything he could to help her.

    I predict that Annette will continue to be uncooperative with this whole legal process. When the final decision is handed down, she won't cooperate with the conditions. She'll challenge them to put her in jail. Also, it will take Child Protective Services removing their 3 boys from their custody for Annette to do anything about the problem of Chad, or to willingly get the mental health care she so desperately Will that happen, who knows?

    Jim, you just hit on the cruz of the deception Team Bosworth is trying to pull off. Not paying the attorney and not cooperating with the attorney are logically incompatible with wanting to keep that attorney. Pure sideshow, intended to make us forget that the whole reason this is happening is that Annette Bosworth lied on six petition sheets.

    The question of keeping her medical license to practice is not one that can seperated from the way she has conducted herself--her refusal to cooperate with another professional-her lawyer; her treatment of employees; her firing from Sanford Health; and the kinds of disputes she has had with the Medical Board of Examiners. As medicine has become a highly consultive process (during a recent surgery, I was visited by 5 doctors a day who had to coordinate and inform each other of their decisions), the kind of thinking, decision-making, and behavior she has demonstrated does raise questions about her ability to practice medicine and make cogent decisions regarding patients. Although, professors do not answer to a medical board, they are subject to annual evaluations which, in accordance with the union contract, could result in constructive plans to deal with behavior that departed from professional standards. One of the toughest things I had to do was sit on a review committee and deal with those few professors whose thinking and behavior became problematic to the point of affecting students and colleagues. Some were terminated for just cause. Others were reassigned and kept away from the classrooms. Such decisions were not based upon whether they conformed or not, but on whether their attitudes and behavior made them ineffective and untrustworthy. That is the kind of question that Bosworth and her cronies raise in terms of the competent practice of medicine.

    Kristi, rarely do I wish someone away from out fair state. I hesitate to wish Annette away, in part because I don't want her to get a fresh start with a bunch of potential marks who aren't wise to her game.

    But I will agree that South Dakota would be better off without the Chad and Annette show. Maybe they will move... after Annette gets off probation.

    I wouldn't worry about what they would do elsewhere, as the only reason they were able to do so much damage here is because they had connections already through family and friends. I do worry about those 3 boys, though. Annette's medical problems will follow her, and Chad seems useless as a bread winner. Annette always wanted to be a "consierge doctor." But if she loses her license here, that plan is out of reach.

    I just checked out Landslide's blog, he's over there talking to himself about the great Dr. Bosworth and how she brought a $25,000 check to court the other day to pay her retainer owed Taliafero, oddly a copy of the check wasn't presented as evidence to her opposition to Taliaferro dumping her.

    Another thing about Landslide's blog, he constantly chastises Cory for blocking his comments here on Madville, but Landslide blocks everybody's comments.

    David Newquist, has the SDBMOE ever gone that far, reaching beyond immediate, demonstrable harm to patients and dealing with behavior such as you describe outside the practice? That was the issue that saved Bosworth during her 2012 hearings before the board: folks could point to whacky behavior, but there was no evidence of harm to patients.

    Roger—whoa! Bosworth brought a $25,000 check to court? Did she say that on the record? If she did, then she just disappeared any appeal she might make for a public defender. Even if no one else saw the check, if Annette is claiming she had it, then she has demonstrated she has the funds to secure her own legal representation.

    Sentiments aside to seek a positive solution to this mess, it blows my mind that Annette thinks she's fighting for her life. This action wouldn't have gone this far if Team Bosworth hadn't taunted the Attorney General so badly. Having said that, it's illogical Jackley wants to send her to jail and separate her from her family for petition fraud. A fine and suspended sentence is as rough as it's going to get unless the defendant chooses to be put in jail, which would be an ultimate failure in the eyes of her children.

    Aside to Annette: You showed us you wanted to be a Senator. You told us your values. You lost the primary and that's okay. Mission accomplished. Politics is not who you are, and now it's time to devote yourself to your family with or without Chad. There are better lawyers who cost a lot less than $25K to get you off of this hook. Stop sawing and climb down from the limb.

    I don't know how the Board has handled other cases. Like the Bar
    Association, it seems to avoid disciplinary actions that might tarnish the profession in some way. I do not know how the Board maintains oversight on its licenses, but here are the specific requirements for the issuing of a license that apply to Bosworth's recent history:

    (2) Submit a certificate of good moral character signed by two persons holding a license or certificate from this board, a similar board in another state, the District of Columbia, the National Board of Medical Examiners, or the National Board of Osteopathic Physicians and Surgeons, who are not at the time of making the certificate under any charge or accusation which would be grounds for cancellation, suspension, or revocation of their license. The persons shall verify that they are personally acquainted with the applicant and know of the applicant's moral character;

    (5) State whether the applicant has ever been convicted of any criminal offense, exclusive of misdemeanor traffic violations, or if any prosecution against the applicant in any court for a felony or a crime involving moral turpitude is pending;

    (6) State whether the applicant has received care or treatment for alcohol abuse, alcoholism, drug abuse, drug addiction, or mental illness;

    (7) State whether the applicant has ever appeared or been requested to appear before any licensing board concerning any violation of law or regulation of any state, district, territory, or province of the United States or Canada;

    (13) State whether the applicant has ever been terminated, asked to resign, or resigned or otherwise not completed any postgraduate or residency training program;

    (14) State whether the applicant has ever been subject to proceedings by a professional society to revoke, reduce, or restrict membership;
    (15) State whether the applicant has ever been notified of a complaint by a medical facility, professional society or association, or any licensing agency;

    Bosworth and her team are using the 24 years in prison as a theme to raise money for her defense fund, whether she uses it or not. I suspect a new attorney will push her to make a plea deal and be done with it.

    IF Chad and Landslide have Dr. Bosworth's best interest, they too will encourage her to accept a slap on the wrest and move on. That is a pretty big IF for a bunch of egotist.

    She will never cave to MJ. I hope she kicks their asses. Wish Brandon would sue. Another young person who got beaten down by the system who will probably end up leaving the state.
